"Disqualifying Crimes" include the following:
Guilty Pleas:
A person should be disqualified and prohibited from serving as a volunteer if the person has
been found guilty of the following crimes:
For purposes of this policy; Guilty shall mean that a person was found guilty following a trial,
entered a guilty plea, entered a no contest plea accompanied by a court finding of guilt
(regardless of adjudication), or received court directed programs in lieu of conviction.
i. Any sex offense, including but not limited to, sexual assault, sexual battery, indecent
exposure, indecent liberties with a minor (child molestation), carnal knowledge of a minor, rape,
sodomy, prostitution, pandering, solicitation, possession of child pornography, etc.;
ii. Any felony including, but not limited to, murder, manslaughter, unlawful wounding, malicious
wounding, aggravated malicious wounding, abduction (kidnapping), robbery, burglary, breaking
and entering, felonious drug offenses, grand larceny, embezzlement, fraud, child abuse and
neglect, etc.;
iii. Any violent misdemeanor within the past seven (7) years, including, but not limited to, simple
assault, battery, domestic assault and battery, hit and run, etc.;
iv. Two misdemeanor offenses related to alcohol within the past five (5) years including, but not
limited to, driving under the influence, drunk and disorderly, public intoxication, etc.;
v. Any misdemeanor drug offense within the previous five (5) years or any multiple drug
offenses within the previous ten (10) years, including but not limited to simple drug possession,
possession of drug paraphernalia, etc.; and
vi. Any other misdemeanor within the past five (5) years that would be considered a potential
danger to children or that would call into question the employee/volunteer's fitness to supervise,
or be entrusted with minors, including but not limited to contributing to the delinquency of a
minor, providing alcohol to minors, etc.
vii. Pending Cases:
Individuals found to have pending court cases for any of the disqualifying offenses will be
disqualified. If the disposition of the pending case does not meet the criteria for the
disqualification as listed above, the individual would then be cleared and reinstated.
